Our Disputes Resolution Policy
Scope
This clause governs any disputes arising out of or relating to the use of this website, the services provided through www.elawpakistan.com, or any associated agreements, whether contractual, statutory, or otherwise.
Negotiation
The parties agree to attempt to resolve any disputes or claims amicably through good-faith negotiation. A written notice of the dispute must be provided to the other party, detailing the nature of the dispute and the resolution sought.
Mediation
If the dispute cannot be resolved through negotiation within 30 days of the notice, the parties agree to engage in mediation. The mediation will take place in Lahore, Pakistan, or through an online platform mutually agreed upon by the parties, with a neutral third-party mediator.
Arbitration
If mediation fails, the dispute shall be resolved by arbitration under the Arbitration Act of 1940 (as applicable in Pakistan). The arbitration will be conducted by a sole arbitrator appointed by mutual agreement or, failing that, by the competent court. The arbitration proceedings shall be conducted in Lahore, Pakistan, and the decision of the arbitrator shall be final and binding on both parties.
Governing Law
This Dispute Resolution Clause and any disputes arising under it shall be governed by and construed in accordance with the laws of Pakistan.
Jurisdiction
Subject to the Arbitration clause, any disputes that require judicial resolution shall fall under the exclusive jurisdiction of the courts of Lahore, Pakistan.
Costs
Each party shall bear its own costs and expenses incurred during negotiation and mediation. However, the costs of arbitration, including the arbitrator’s fees, shall be borne equally by both parties unless otherwise directed by the arbitrator.
Exclusions
This Dispute Resolution Clause shall not apply to:
- Any claim for injunctive relief or specific performance.
- Disputes where www.elawpakistan.com is required by law to initiate or participate in proceedings before a public authority.
Amendments
www.elawpakistan.com reserves the right to amend this Dispute Resolution Clause from time to time. Any changes will be communicated through the website and will apply prospectively to disputes arising after the amendment.
